These Terms and Conditions govern the carriage, forwarding and handling of shipments by Premium Postal Service ("we", "us", "our") and your use of https://premiumpostalservice.com. By tendering a shipment to us, requesting a quote, or using this website, you ("the Customer") accept these Terms on your own behalf and on behalf of the shipper, consignee and owner of the goods.
We provide freight forwarding, courier and logistics services, including air, ocean and road freight, customs clearance assistance, warehousing and last-mile delivery. We may perform any part of the service ourselves or through sub-contracted carriers and agents.
Quotations are estimates based on the information you supply and are valid for the period stated. Final Charges are calculated on the actual weight, volumetric weight, dimensions, contents, route and applicable duties of the Shipment. Where the actual particulars differ from those declared, we reserve the right to re-weigh, re-measure and re-rate the Shipment, and to invoice the difference.
Customs duties, import taxes, inspection fees, clearance charges, demurrage and storage may be levied by customs authorities, airlines, ports or handling agents. Unless expressly agreed otherwise in writing, these are payable by the Customer or the Consignee in addition to the freight charge. We will notify you of such charges and, where applicable, request payment before the Shipment can proceed. We do not profit from duties and taxes levied by a government authority; these are passed through at cost.
A booking is accepted only once we have issued a tracking number. We may refuse any Shipment at our discretion, including where the goods are unsuitable for carriage, inadequately packed, prohibited, or where the required documentation has not been provided.
You may not tender, and we will not knowingly carry, any of the following:
You are responsible for ensuring the Shipment is lawful. Tendering a prohibited item is a material breach of these Terms, and you indemnify us in full against any resulting loss, fine, penalty or claim.
You must pack the Shipment adequately for the mode of transport and handling it will undergo, and label it clearly and accurately. You are responsible for the accuracy and completeness of all documentation, including the description of goods, declared value, HS codes, invoices, permits and licences. We are not liable for loss arising from inadequate packing or from incorrect, incomplete or misleading documentation.
We, and any carrier, customs authority or security agency, may open, inspect, x-ray or scan any Shipment at any time without notice to you.
Where we act as your agent for customs purposes, you authorise us to make declarations and pay duties and taxes on your behalf, and to appoint sub-agents where required. You remain responsible for the accuracy of the declared value and description of the goods. Delays caused by customs, border agencies or regulatory inspection are outside our control.
Transit times and delivery dates are estimates given in good faith and are not guaranteed unless we have expressly agreed a guaranteed service in writing. We are not liable for delay caused by customs, weather, strikes, carrier schedules, security screening or any event outside our reasonable control.
If a Shipment cannot be delivered - because the address is incorrect, the Consignee refuses it, the Consignee cannot be located, or Charges due are not paid - we will attempt to contact you. Storage charges may accrue. If the Shipment remains undeliverable, we may return it to the Shipper at the Shipper's cost or, after a reasonable period and notice, dispose of it in accordance with applicable law.
Charges are payable in the currency stated on the invoice and are due on the terms shown on the invoice or payment request. We may withhold delivery of a Shipment, and exercise a lien over it and its documents, until all Charges owed to us in respect of that Shipment are paid. All payments must be made through the payment methods we publish; we accept no responsibility for funds sent to any account or channel we have not authorised in writing.
Our liability for loss of or damage to a Shipment is limited to the lesser of its declared value, its actual repair or replacement value, or the limit imposed by any applicable international convention (including the Warsaw or Montreal Convention for air carriage, and the CMR for road carriage). Where no convention applies, our liability is limited to the amount stated in our tariff. We are not liable in any circumstances for indirect or consequential loss, including loss of profit, loss of market, or loss of business opportunity, however caused.
The Charges do not include insurance. We strongly recommend that you insure the Shipment for its full value. Where we arrange insurance at your written request, we do so as your agent and are not the insurer.
Any claim for loss, damage or delay must be notified to us in writing as soon as possible and, in any event, within fourteen (14) days of delivery or, in the case of non-delivery, within fourteen (14) days of the date the Shipment should have been delivered. Claims must include the tracking number, evidence of value and, in the case of damage, photographs and retention of the packaging for inspection. Claims submitted outside these time limits may be rejected.
Refunds of Charges are governed by our Refund Policy, which forms part of these Terms.
You warrant that you are entitled to tender the Shipment, that the description and value are accurate, and that the Shipment complies with all applicable laws. You indemnify us against all claims, penalties, fines, duties, costs and expenses arising from any breach of this warranty.
We are not liable for any failure or delay in performing our obligations caused by an event outside our reasonable control, including acts of God, war, civil unrest, strike, epidemic, government action, port or airport closure, or the failure of a third-party carrier.
We process personal data in accordance with our Privacy Policy.
We may amend these Terms from time to time. The version published at https://premiumpostalservice.com at the time your Shipment is accepted is the version that applies to it.
These Terms are governed by the laws of the country in which Premium Postal Service is registered, and the courts of that country have exclusive jurisdiction, without prejudice to any mandatory consumer protection rights you may have in your country of residence.
